Migori Governor Okoth Obado and his two aides Micheal Oyamo and Caspal Obiero will remain in police custody until Friday when the High Court is set to hear their bail application.
Justice Jessie Lesiit has ruled the court will hear and determine their bail application on Friday October 12.
The lawyers representing the trio have made fresh bail application pending hearing by Lady Justice Jessie Lesiit at the Milimani Law Courts.
The High Court has allowed the State to merge their murder cases over the killing of Rongo University student Sharon Otieno.
The three suspects now face two counts of murder, that of killing Ms Otieno and her unborn child.
Obado was remanded at Industrial Area Prison in Nairobi, but is now hospitalised at the Kenyatta National Hospital.
The governor has been in remand since September 22.
